INTERPOL Red Notices: consequence, misconception and safeguard

What the notice does

INTERPOL describes a Red Notice as a request to locate and provisionally arrest a person pending extradition, surrender or similar legal action. It is based on an arrest warrant or judicial order from the requesting country. Whether it produces arrest, travel restriction or another consequence depends on the law and practice of the country in which the person is found.

Not every Red Notice is publicly visible. A person may first learn of international data through travel disruption or a domestic process. Legal advice should therefore distinguish public notices, non-public data, diffusions and separate national alerts.

Review and challenge

The Commission for the Control of INTERPOL’s Files is an independent body responsible for ensuring that personal data processed through INTERPOL channels complies with the organisation’s rules. Requests may seek access, correction or deletion, but the process is documentary and should be prepared with the originating case, procedural history and relevant INTERPOL rules in mind.

A CCF application does not replace action in the requesting country or advice in a state where arrest is possible. Parallel strategy may be needed to address the underlying warrant, extradition risk, immigration consequences and inaccurate national records.

Avoid dangerous assumptions

Public commentary often treats a Red Notice as proof of guilt or a global warrant. Neither is correct. Equally, deletion from INTERPOL systems does not automatically cancel the domestic case or all national consequences. The strategy must identify each legal layer and obtain authoritative confirmation of changes.
