Jurisdiction, interim relief and enforcement should be considered at the first sign of conflict, not after an award is obtained.
The clause is the first procedural asset
An arbitration clause should identify the seat, institution or rules, number of arbitrators, language and scope. Ambiguity may produce satellite litigation before the merits begin. Parties should also examine whether connected contracts contain inconsistent clauses that fragment one commercial dispute into several forums.
The seat determines the supervisory court and procedural framework; it is not merely the city where hearings occur. Governing law, seat and enforcement forum perform different functions and should be selected deliberately.
Build the case and enforcement map together
At the first serious sign of breach, counsel should preserve evidence, identify witnesses and analyse urgent measures. In parallel, the team should locate assets, security and counterparties because the likely enforcement states may affect how relief is framed and which respondents are included.
Tribunal orders and court measures can complement one another, but availability and standards vary. A strategy may require emergency arbitration, applications to the courts at the seat, or protective steps where assets are located.
An award is not the end
The New York Convention supports recognition and enforcement of foreign and non-domestic awards across contracting states, subject to limited grounds for refusal. Practical success still depends on correct service, a valid arbitration agreement, procedural fairness, a properly reasoned award and reachable assets. Enforcement thinking should shape the case from day one.
